Sustainability, Scrubbers, and Sanctions: Pollution Trends to Watch Throughout the Year

21/09/2026

The maritime industry is facing more environmental rules and expectations than ever before. New emissions standards, continued enforcement under the Oil Pollution Act, and growing pressure to operate sustainably are all changing how vessel operators manage risk. As we are now in the second half of 2026, we are continuing to track several trends that are shaping compliance requirements and driving new types of claims across the industry.

“Routine” Spills: Why Small Incidents Matter

While large-scale pollution events make headlines, it’s often smaller spills that create the most claims activity. Recently, our claims team handled a case where about 3,500 gallons of diesel fuel spilled in Izhut Bay, Alaska. Due to this, the Coast Guard required public notice to be shared via a media outlet, explaining how third parties could file claims for any damage caused by the spill. These public notices are part of the process under the Oil Pollution Act of 1990 (OPA 90), showing that even small incidents can grow quickly and lead to significant financial and operational impacts if not handled properly.

Scrubbers and Sustainability: Compliance Under the Microscope

Since IMO 2020 took effect, many vessel operators have used scrubber systems to reduce sulfur emissions and stay compliant. But as environmental rules tighten, regulators are paying closer attention to how and where scrubbers discharge wash water, especially in protected marine areas.

Looking ahead to 2026, more dialogue on scrubber discharge is expected. This shift is pushing the industry toward cleaner fuels and new technologies, but it also makes compliance and environmental risk management more complex for shipowners.

Enforcement: A Changing Risk Landscape

Stricter and stronger enforcement are changing how vessel operators think about risk. Pollution incidents that once only led to environmental fines can now also involve mandatory injunctions, especially when vessels operate near restricted areas or certain flagged regions.

These overlapping risks are making compliance more complex. Operators need to stay aware of both environmental and geopolitical factors that could turn a single pollution event into a broader challenge.

Response Readiness: Preparation is Protection

Recent pollution events have shown that preparation is critical. Acting quickly and following proper protocols can help reduce costs, limit exposure, and protect a company’s reputation.
